Acceptable Use Policy (“AUP”)

This Acceptable Use Policy (“AUP”) applies to all Users of HoopsBI, LLC, a Wyoming limited liability company (“Provider” "we," "us," or "our")’s subscription‑based analytics platform (the “Platform”) and is incorporated by reference into the Services Agreement. Capitalized terms not otherwise defined have the meanings set forth in the Agreement.

1. Purpose

The Platform enables authorized users to [submit], access, and analyze player, agent, coach, and club information along with interview responses, surveys, and other user‑generated content. This AUP sets forth prohibited activities to protect the integrity, security, and legal compliance of the Platform and its users.

2. Definitions

“User Content” means any data, text, files, links, information, or other materials submitted by a User (including Customer Data).

“Platform Services” means all online, API, and related services provided via the Platform.

3. Use of Proprietary Modeling and Analytics

Users may not reverse engineer, decompile, disassemble, extract, replicate, or otherwise attempt to derive the underlying methodologies, ranking algorithms, predictive models, or data structures used in the Platform’s analytics dashboards or reports. Users further agree not to use the insights, rankings, or output generated by the Platform to build or train competing products, services, or models, whether directly or through third parties. Any violation of this provision is a material breach of the Service Agreement https://hoopsbi.com/terms-of-use and may result in immediate suspension or termination of access, without notice, in addition to any legal remedies available to the Provider.

4. Prohibited Uses

You may not use the Platform Services or submit User Content in any way that:

  • Violates Law or Rights

  • Violates any applicable law, regulation, or third‑party right (including intellectual property, privacy, publicity, or data protection laws).

  • Submits defamatory, harassing, obscene, or hateful material directed at any individual or group.

  • Infringes Intellectual Property

  • Uploads or shares content you do not own or have a right to use.

  • Circumvents copyright protection measures or posts infringing materials.

  • Compromises Privacy

  • Publishes or discloses personal data (e.g., home address, sensitive biometric identifiers) about an identifiable individual without their consent.

  • Encourages or assists any third party in obtaining unauthorized access to personal data.

  • Misuses User‑Reported Data

  • Submits knowingly false, misleading, or fraudulent information (including fake interview responses or fabricated scouting notes).

  • Attempts to manipulate aggregated metrics or ranking algorithms by flooding the system with false data.

  • Abuses Platform Functionality

  • Reverse engineers, scrapes, mines, or harvests data from the Platform, including automated data extraction from dashboards or API endpoints.

  • Interferes with or disrupts the Platform’s operation, security, or performance (e.g., by launching denial‑of‑service attacks).

  • Promotes Unlawful Activity

  • Uses the Platform to facilitate or plan criminal or fraudulent activities.

  • Offers, advertises, or sells illegal products or services.

  • Circumvents Controls

  • Attempts to bypass user authentication or other access controls.

  • Creates multiple accounts to evade usage limits or content moderation.

5. Submission Guidelines

When submitting User Content, you agree to:

  • Provide accurate, truthful, and up‑to‑date information.

  • Respect trademark, copyright, and publicity rights of individuals and organizations.

  • Obtain consents for any personal data you upload, and comply with all data‑protection obligations.

6. Enforcement and Remediation

  • Investigation & Suspension: Provider may investigate any suspected AUP violations and, at its discretion, suspend or terminate access for any User or Customer.

  • Content Removal: Provider reserves the right to remove or block any User Content that violates this AUP.

  • Notice & Cure: Where feasible, Provider will notify Customer of violations and allow a cure period (typically 5 business days) before suspension.

  • Escalation: Repeated or egregious violations may lead to immediate termination of the Agreement and referral to legal authorities.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it promptly to support@hoopsbi.com  with sufficient detail for investigation.

By using the Platform Services or submitting any User Content, you acknowledge that you have read, understood, and agree to comply with this AUP. Failure to do so may result in suspension or termination of your access and, if applicable, your organization’s subscription.
